Can my company get a business loan despite payment remark?

Qred makes an overall assessment of the company. A record of non-payment is of course negative.

What is a payment remark?

A payment remark means that the company has not paid its debts on time and the debt has been sent to the Swedish Enforcement Authority. Credit reference agencies register it as a remark. Most credit reference agencies collect information on new debts on a daily basis and record it in their registers.

What happens if the company receives a payment remark?

For example, a payment remark may prevent the company from obtaining a business loan from the bank, not being able to take out telephone subscriptions, for example, or being forced to make advance payments.

Are there different types of payment remark?

Payment remarks can be divided into two types:

  • General cases (taxes and fees to public authorities): These are payment demands from the public sector, i.e. from the state, municipality, county council or authorities. A general claim normally arises after a company has not paid taxes, VAT, employer's contributions, parking fines or other public charges on time.
  • Individual cases (debts to private creditors): these are normally payment claims from private companies. A payment remark arises after a company has failed to pay its bills on time, for example for rent, accounts payable or loans.
How do I know if my company has a payment remark?

A credit reference agency can inform you of this - as they are the ones who set payment defaults. Credit reference agencies collect public information from various registers, including the Swedish Enforcement Authority. This information is then provided to various questioners, such as banks, landlords and credit companies. The Swedish Data Protection Authority's website contains a complete list of credit reference agencies.

How long does a payment remark last?

Credit reference agencies usually retain data on companies for five years after the date of registration of the alert. When an application for an order for payment is registered against a company, this information is kept for a maximum of two years after the end of the year in which the application was made.

What is an order for payment?

Applying for an order for payment does not mean that you have been given a default notice. An order for payment is issued if the application leads to a decision, i.e. Kronofogden makes a decision that the application is correct. It is credit reference agencies that issue payment defaults, not us. Credit reference agencies obtain public data from various registers, including the Swedish Enforcement Authority.

What is required to keep a remark confidential?

The debt is automatically marked as confidential by Kronofogden if the following conditions are met. Please note that it is not possible to apply for confidentiality.

  • No previous debt recorded in the last two years
  • That you have paid the amount of the debt, including interest, any late payment fee and basic fee, or that the case has been withdrawn by the creditor.
  • That you will not incur any new debt in the two years following the confidentiality of a debt.
Can I get rid of a payment remark?

In most cases, the default notice does not have to remain if you got it by mistake. The mistake could be, for example, that you accidentally made an incorrect payment or that the person who sent the debt should not have done so. There is specific legislation that determines whether the data can be changed or perhaps removed altogether. Normally you cannot get rid of a payment remark.

Can you start a business if you have a payment default?

Yes, you can. But it can be more difficult to get started, even if the business and personal finances are kept separate, it can be challenging.

Can you get a loan if you have a payment remark?

It depends. But often you can find solutions to the problem. It is simply on a case-by-case basis.
